Statespay Technologies LLC (“Statespay,” “we,” “us,” or “our”) provides financial technology services, including peer-to-peer transfers, virtual cards, and fund loading via cards, ACH, or wire (the “Services”). By accessing or using our Services, you agree to comply with these Terms of Service (“Terms”). If you do not agree, do not use our Services.


1. Acceptance of Terms

By creating an account or using our Services, you confirm that:

  • You are at least 18 years old and a U.S. resident.
  • You accept these Terms and our Privacy Policy.
  • You consent to electronic communications.

2. Eligibility

Our Services are available only to:

  • Individuals aged 18+ who can form legally binding contracts.
  • Businesses authorized to operate in the U.S.
  • Users who pass identity verification (KYC) via Plaid or other third-party providers.

We may deny accounts to anyone, at our sole discretion.


3. Account Registration

You agree to:

  • Provide accurate, current, and complete information (e.g., name, email, SSN, government ID).
  • Update your details promptly if they change.
  • Keep login credentials secure. You are responsible for all activity on your account.

4. Services

Statespay offers:

  • P2P Transfers: Send/receive funds between Statespay users.
  • Virtual Cards: Access to virtual debit cards.
  • Fund Loading: Add money via debit/credit cards, ACH, or wire.
  • Banking Services: Provided through FDIC-insured partners (e.g., Bluebanc, Sila Money).

Note: Statespay is a fintech company, not a bank.


5. User Responsibilities

You agree not to:

  • Use the Services for illegal activities (e.g., fraud, money laundering).
  • Violate laws, third-party rights, or these Terms.
  • Share your account with others or use it for unauthorized commercial purposes.
  • Reverse-engineer, hack, or disrupt our Services.

6. Fees

  • No monthly fees.
  • Transaction fees (e.g., card loads, wire transfers) apply as disclosed in-app.
  • Third-party fees (e.g., ACH, card networks) may apply.

7. Prohibited Transactions

You may not use our Services for:

  • Gambling, adult content, or cryptocurrency purchases.
  • High-risk businesses (e.g., weapons, narcotics).
  • Circumventing anti-money laundering (AML) laws.

We may freeze accounts or withhold funds for suspicious activity.


8. Termination

We reserve the right to:

  • Suspend or terminate your account without notice for violations.
  • Hold funds for up to 90 days to comply with legal obligations.

You may close your account anytime via the app.


9. Disclaimers

  • No Warranties: Services are provided “as-is.” We do not guarantee uninterrupted or error-free access.
  • Third-Party Partners: Banking services are FDIC-insured through partners like Bluebanc and Sila Money.
  • Limitation of Liability: We are not liable for indirect, incidental, or punitive damages.

10. Governing Law

These Terms are governed by Delaware law. Disputes will be resolved through binding arbitration (not in court).


11. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance. We will notify you via email or in-app alerts.
